Opportunity Scholarships Allowed Ahead Of Future Ruling
Judge Hobgood ruled yesterday that North Carolina’s Opportunity Scholarships will be allowed to proceed – for now.
RALEIGH, N.C. — A North Carolina judge won’t block a state agency from distributing taxpayer money to cover private school tuition in advance of a hearing to determine whether the program championed by Republican lawmakers is legal.
Wake County Superior Court Judge Robert Hobgood said Wednesday he won’t issue an injunction blocking the State Educational Assistance Authority from paying out $10 million in government-funded scholarships to students who won a lottery for tuition assistance to attend private or religious schools.

Sources say that Judge Hobgood’s ruling today allowed Speaker Tillis and Senator Berger’s motion to intervene. This allows them to be parties to the suit. By denying the plantiff’s injunction request, this ruling allows children who have already been selected to receive Opportunity Scholarship funds.

About That Busload of Alleged Illegal Immigrants In NC
A video is making the rounds of a busload of alleged illegal immigrants being dropped off in a Wal-Mart parking lot to go shopping right here in North Carolina.
The video was originally posted by Sylvia Locklear on Facebook. Allegedly, this took place this past Sunday afternoon, none spoke English and, according to Locklear, they had EBT cards in hand to pay for their purchases. This video, according to the Facebook comments, took place off exit 60 in Kannapolis, North Carolina.
As it turns out, Locklear reports that apparently that busload of folks are farm workers who have Green cards to work in China Grove:

One still has to wonder why they are being bused places on a school bus and what about the supposed cards they were using to pay for their purchases?

James Everett Dutschke Sentenced to 25 Years
UPDATE:
After last weeks dramatic attempt of change of plea, James Everett Dutschke has been sentenced to 25 years in prison for the making and mailing of ricin to elected officials.
According to Djournal, before handing down the sentence, Judge Aycock asked Mr. Dutschke if he would like to speak, Dutschke replied before laughing:

NC Teacher Tenure Injunction Stays In Place
Yesterday, Judge Hobgood made the injunction blocking the teacher tenure law permanent.
Durham schools officials celebrated the news Friday that a Wake County judge declared the effort in the General Assembly to end “career status” for North Carolina teachers unconstitutional.
Judge Robert Hobgood ordered a permanent injunction against the Republican-backed law that required school districts to offer 25 percent of teachers contracts and $500 bonuses to those who agreed to give up “career status” early, before 2018 when it would end for all teachers.
The ruling came in response to a lawsuit filed by the N.C. Association of Educators (NCAE) and six teachers, challenging the law that would strip teachers with “career status” of certain rights such as the right to a hearing if they were dismissed. – Herald Sun 05/16/14
While I oppose the current rules governing teacher tenure which include tenure being granted automatically when at teacher hits the four-year mark of continuous employment in North Carolina, this ruling actually makes sense with regard to the NC Constitution as written. Perhaps the NCGA should look at a route which incentivizes teacher to apply for a merit system instead of trying to drop tenure entirely. This would avoid the kind of suit brought by the NCAE. A search of NClet.net brought up the last time NC looked at teacher tenure with a legislative research committee. That it was 1981.
Judge Hobgood is the same Judge in Wake County that had another teacher related injunction dealing with Opportunity Scholarships overturned:
