Lewis Backs Out Of Court Candidates Forum
The Federalist Society held a major forum this week for candidates seeking office in the North Carolina Court System. Regrettably, I was unable to attend, but it looks like the event was a great success:

We’ve covered some of the main races here on the blog, including the interesting Supreme Court Justice race. Both Supreme Court Justice candidates (Justice Mark Martin and Judge Ola Lewis) were invited to the forum, however it looks like Judge Ola Lewis backed out due to an ‘unspecified’ conflict:

MO Ed Commissioner, Governor Sued By Citizens Over Common Core SBAC Test Funds

Fred N. Sauer of Missouri is suing Governor Jay Nixon and other state officials over the $4.3 million paid to Smarter Balanced Assessment Consortium (SBAC) in relation to the Common Core State Standards tests.
The editors of Missouri Education Watchdog have joined the suit as plaintiffs. The main points of the suit are the challenging of the use of taxpayer money for the SBAC, that the SBAC is an unconstitutional interstate compact and that Governor Nixon and Commissioner Nicastro’s conduct violated federal and state statutes. Nicastro announced her retirement just this past week.

NC Supreme Court Denies Emergency Fund Release For Opportunity Scholarships
Legislative leaders asked the NC Supreme Court for an emergency release of funds for the Opportunity Scholarships while the decision of Judge Hobgood is being appealed.
The News and Observer piece doesn’t make mention of the legal representation for the parents who has also filed an emergency motion. Representation for the parents in the suit also filed with the NC Supreme Court. I haven’t seen where this motion has been ruled on yet. It asks for the funds for those children already accepted to be released so they are not in academic limbo.

Opportunity Scholarships Suit Goes To NC Supreme Court
Last week, Judge Hobgood struck down Opportunity Scholarships for low-income and at risk kids. The lawyers representing the parents in the suit filed an emergency motion, which was then dismissed by the Court of Appeals and instructed the parties to refile when a written order is entered. The attorneys for the parents told me that “There is NC law which says our appeal was appropriately filed without a written order.” Even so, the attorneys for the parents have refiled and the suit heads now to the NC Supreme Court.

NC Supreme Court Race Turning Nasty?
y law, the current Chief Justice of North Carolina has to step down when they turn 72. The current Chief Justice passes that birthday this August, which has prompted the Governor to appoint Justice Mark Martin (who is also a candidate for the slot) to fill the void temporarily until the general election in November. This turn of events has the other candidate on the ticket making some angry sounding statements:

Emergency Motion Filed Over Opportunity Scholarships Ruling
The attorneys for the parents in the case of the NC Opportunity Scholarships filed an emergency motion late Friday afternoon. I’ve obtained a copy of the motion: Emergency Motion and Appdx. The case being made is that this ruling has put the education of hundreds of children in limbo.
