Holder’s DOJ: ‘No Fundamental Right To Homeschool’

Eric Holder is the most corrupt and slippery AG in our nations history. His DOJ has sued states, pollsters and businesses across the board, but nothing as flat-out Constitution violating as their next possible target: Homeschoolers. Caffeinated Thoughts has the story which stems from an asylum case filed by a Germany family, the Romeike’s,  being persecuted for homeschooling. (Read: Romeike DOJ Merits Brief)

Excerpt from Caffeinated Thoughts:

…There are two major portions of constitutional rights of citizens—fundamental liberties and equal protection. The U.S. Attorney General has said this about homeschooling. There is no fundamental liberty to homeschool. So long as a government bans homeschooling broadly and equally, there is no violation of your rights. This is a view which gives some acknowledgement to the principle of equal protection but which entirely jettisons the concept of fundamental liberties.

Choosing the type education for one’s own child is pretty much one of the most basic fundamental rights any parent has.  What this position says to me is that in the education ‘reforms’ we are going to be handed down by this President in his second term, homeschooling will be a moving target.

So, what’s going to happen next? Well,  we’ve already seen the attempt to stamp out homeschooling by attacking religious freedom. That hasn’t deterred people, however, as Professor Glenn Reynolds points out:

“What about home schooling? You know, it’s not just for scary religious people any more.” That’s a line from Buffy The Vampire Slayer, and it should strike fear into the hearts, not of vampires, but of public-school administrators everywhere.

The fact is, Americans across the country — but especially in large, urban school systems — are voting with their feet and abandoning traditional public schools, to the point that teachers are facing layoffs. Some are going to charter schools, which are still public but are run more flexibly. Some are leaving for private schools. But many others are going another step beyond traditional education, and switching to online school or even pure home schooling.

No. The DOJ will take new routes apart from religious based homeschooling. They need a wider net to catch the increasing numbers of families pulling out what I have come to call the ‘Great Public School Experiment’.  Holder and the DOJ will be the instrument by which homeschooling families will be attacked with using a variety of charges, which I would think would include things from not meeting standards set by the state to child abuse and/or sexual abuse claims.  Doesn’t matter if the claims are true or not, the suits themselves are meant to send a message.

The media will help deliver that message with stories like this one: “New Mexico homeschooled teen Nehemiah Griego accused of murdering family, planned to keep killing at local Walmart

Why is his schooling status in the headline? Because it’s important to make sure people know homeschooling families have something wrong with them or that homeschooling turns children crazy.  Homeschooling threatens the government monopoly. It must be banned!
Don’t think the unions will sit this out either. (Read: CA Teachers Union Attacks Homeschooling – This is from 2008, however given the school choice push and increase in homeschooling, it is very relevant.)

Since the one in charge, the President, is responsible for his underlings behavior one has to conclude that the DOJ is under his control and that anything they say id to be treated as if the President–himself–said it. So, The President encourages the wild behavior of that department and is responsible for the results/
